BUYER agrees to purchase from SELLER the aforementioned purebred Entlebucher Mountain Dog puppy. SELLER guarantees this Dog is in good health and free of communicable diseases at the time of sale. This puppy has had the appropriate inoculations and worming for its age, as documented in accompanying Health Record. If, within 7 days from the time BUYER takes possession of this dog, the dog purchased is found by a qualified licensed veterinarian not to be in good health, then SELLER agrees to refund the purchase price* upon return of this dog to SELLER. (*All shipping and handling charges are non-refundable and the responsibility of BUYER.) Said refund will be offered only upon receipt of a report from a licensed veterinarian, and verification by SELLER'S veterinarian. If dog is too seriously ill to be returned to SELLER, a reputable licensed veterinarian of BUYER'S choice may treat the dog. When the health of this dog is improved enough for travel, it must be returned to SELLER, along with the accompanying veterinary report, and SELLER agrees to incur any reasonable expense authorized by SELLER during recovery. SELLER must be in touch with said veterinarian to authorize treatments for which SELLER is expected to pay.
There is no guarantee this puppy is free of hip dysplasia, cataracts or other unknown genetic conditions. As we find solutions to one genetic condition, we seem to discover other less-known problems that lie within the small gene pool of this breed. SELLER agrees that if this Dog requires extensive medical surgeries within one year of birth (due to undetected medical conditions present at birth), and the cost of those surgeries exceed the original purchase price of this Dog, then SELLER will provide BUYER with a replacement puppy of equal value from a future litter. SELLER agrees that if this dog should die within one year of birth (due to any undetected congenital problems), SELLER will replace this dog with a puppy of equal value from a future litter. In either instance, BUYER must provide SELLER with the veterinarian's report as verification of the health conditions of this Dog. SELLER is not required to refund any monies spent on medical treatment, either up to or exceeding the purchase price of this Dog.
SELLER cannot be responsible for the temperament of this dog. Adult canine temperament is dependent upon continued proper socialization, training, and handling on the part of the BUYER. Tying by rope or chain, kenneling, or leaving dog alone for extended periods of time is not appropriate for this breed and may result in aggressive or nervous temperament. SELLER highly recommends this dog be taken to professionally run obedience classes beginning as early as 10 weeks of age. Under no condition is this dog to have any attack dog training .
All dogs from this kennel are symptomatically free of PRA. However, it is strongly recommended that all puppies be DNA blood tested to determine if they are genetically free of PRA. It is required by the NEMDA Breed Club that each breeding dog have an individual DNA test and certification. At 24 months of age, it is also required that all breeding dogs have their hips x-rayed, that the x-rays be sent to PennHIP (or OFA) for evaluation/certification, and that the dog's eyes be evaluated by a CERF-certified veterinary ophthalmologist. These tests are REQUIRED if this dog is to be used for breeding. The tests are strongly recommended for all pups from this kennel for information and health evaluation purposes. Any cost incurred by such testing is the sole responsibility of BUYER. If cataracts or any other genetic condition is diagnosed, or if the dog is determined to have any degree of hip dysplasia, BUYER agrees to spay/neuter this dog ASAP to prevent accidental breeding. SELLER must be provided with copies of results of all tests for lineage documentation purposes.
BUYER is obligated to provide adequate food, lodging and exercise to maintain the physical and mental health of this dog. BUYER is responsible for providing this dog with regular medical care and necessary medication to maintain good health, including but not limited to an annual exam by a veterinarian and a full set of annual booster vaccinations.
BUYER agrees to have this dog spayed/neutered at 2 years of age if his/her hips, heart and/or eyes prove unsuitable for breeding, or if he/she shows signs of any other hereditary diseases. This dog shall not be used for breeding without the explicit consent of the breeder, and may be repossessed by SELLER if such event occurs, with no refund to BUYER. SELLER will provide registration certificate for this dog to BUYER upon receipt of proof of sterilization by a qualified licensed veterinarian, or upon proof that this dog is suitable for breeding through presentation of copies of hips, eyes and heart evaluations by said veterinarian specialists, and certification by said institutions.
Should BUYER at any time be unable to keep this dog, SELLER reserves the right to take it back into ownership, accompanied by it’s appropriate registration certificate duly signed. Refund to be negotiated, but not to exceed 50% of original purchase price. If SELLER does not exercise this option, this dog may be resold. New owners must agree to abide by the provisions of this contract. SELLER agrees to help place this dog in a new home, if requested by BUYER. Under no circumstances may this dog be sold to any research institution for experimental purposes, nor be taken to a Humane Society (dog pound). If no new home can be found, BUYER has the right to return this dog to SELLER, accompanied by its registration certificate and assigned transfer, with no refund to BUYER.
The above agreement is made and signed this ___ day of ________ 2006, by the parties whose names follow below, to assure the well-being of the dog involved. This contract shall be deemed legally binding.
